GUIDE 02 / 12REPRESENTATION

Buyer Agency Agreement.

A written buyer agreement defines the working relationship between you and your real estate professional. Read it carefully and ask questions before signing.

THE BIG PICTURE

What a buyer agreement covers, why it matters, and what to ask before signing.

Know what services you receive

The agreement should describe the broker’s role, the scope of representation, and what assistance is included.

Understand the compensation terms

Compensation is negotiable. Review how your agent is paid, whether another party may contribute, and what you could owe under the agreement.

Review the duration and scope

Check the agreement’s start and end dates, any geographic or property limitations, exclusivity provisions, and how it may be changed or terminated.

Ask about agency relationships

Understand who represents whom and how situations involving a seller, listing brokerage, or multiple clients will be handled.

Get clarity before touring

Written buyer agreements are generally required before in-person or live virtual tours when working with an MLS participant under applicable REALTOR® rules. Specific exceptions and state rules can matter.

Questions worth asking

  • What exactly am I agreeing to pay, and under which circumstances?
  • How long does this agreement last, and can it be changed?
  • Will a seller contribution toward fees affect my offer strategy?
